Business Hub Portal Terms & Conditions March 2018

These terms and conditions (“Terms”) governing the use of the Business Hub Portal (“System”) create an agreement between you and Digi Telecommunications Sdn. Bhd. (“Digi”). By clicking “Agree”, you confirm you have read the Terms, that you understand them and that you agree to be bound by them. You must not access the System if you do not agree to any or all of the Terms.


1. Intellectual Property Rights; Use of Information

 
1.1 The Digi logo, and all other trademarks, service marks, graphics and logos used in connection with Digi or our communication/information services are trademarks or registered trademarks of Digi or Digi’s licensors. Other trademarks, service marks, graphics and logos used in connection with our communication/information services may be the trademarks of other third parties.
1.2 These Terms do not transfer from Digi to you any Digi or third party intellectual property, and all rights, titles and interests in and to such property will remain solely with Digi. Your use of our communication/information services grants you no right or license to reproduce or otherwise use any Digi or third party trademarks. You may also not download, transfer, publish, alter or use any of Digi’s logos, symbols or trademarks displayed in the System for any purpose unless prior permission of Digi is obtained. Further, if you seek to reproduce or otherwise use any material in the System in any manner which would involve the exercise of Digi’s rights or the rights of a third party intellectual property owner, it is your responsibility to seek permission for that use from Digi or the relevant third party.
1.3 You shall be liable for any damages resulting from any infringement of copyright, trademark or other proprietary right, or any other harm resulting from your wrongful use of the System.
1.4 To the extent any information and data is supplied by you or on your behalf, Digi will not be required to independently verify the accuracy and completeness of such information and data.
   

2. Availability and Security

 
2.1 Digi will use reasonable efforts to ensure the availability and security of the System and the integrity of the data accessed by you. Digi will not be able to guarantee that the System will be completely free of viruses or other harmful components, security intrusions or that access to the System will be free from interruption or interception of any communications through the internet or for changes to or losses of data.
2.2 You must ensure that you do not (or procure any person) to insert any virus or harmful components which would have the effect of disrupting, impairing, disabling or otherwise adversely affecting or shutting down or compromising the security or integrity of data, the System or denying Digi access to all or any portion of the System.
2.3 Digi may, in its absolute discretion, withdraw or suspend your use of or access to the System which may include any breach of the Terms.
   

3. Credentials

 
3.1 Use of the System requires a confidential password that will permit access to the System. If you lose or forget your password, you should follow the procedure as set out in the System to reset your password. If you are unable to reset your password using the above method, please call our Partner Support at 016 299 8899. You shall keep your password for the System confidential at all times and not reveal or disclose to any unauthorised persons save that you may disclose such password to your authorised employees and/or agents.
3.2 You will be responsible for all acts of unauthorised use of your credentials. You agree that if you disclose your password to a third party, any action or request made by the user of your credentials will be deemed to have been made by you and the request may be carried out by Digi without further enquiry.
   

4. Third Party Websites

 
4.1 Digi makes no representation whatsoever about any other third party websites that you may access through the System. Digi (i) does not and have not endorsed; (ii) does not and have not accepted any responsibility for such third party websites content or use; and (iii) is not affiliated in any way with such third parties’ website owners. Digi does not investigate, verify, monitor or endorse any third party websites and Digi excludes all liability arising in connection with the use of any information on such third party websites.
   

5. Limitation of Liability

 
5.1 The information on the System is provided on an "as is" basis and Digi shall not be liable for any inaccuracies or omissions contained in the System. To the fullest extent permitted under applicable law, Digi expressly disclaims all representations and warranties of any kind with respect to the System and any other products or services available on or through the System, whether express or implied, including but not limited to, any and all warranties (i) of non-infringement and title; (ii) of merchantability or fitness for a particular purpose; (iii) that any use of the System will be free from any inaccuracies, interruptions, delays, server down-time, errors or omissions as well as data corruption, breaches of data or access credentials or security of System; (iv) that the System will be secure, free of viruses or other harmful components; (v) that the System will satisfy your requirements or expectations; and (vi) that information, data or materials presented or displayed on the System are correct, accurate or reliable.
5.2 5.2 Digi excludes all liability for any loss or liability resulting, directly or indirectly, or arising in connection with (i) any of the above representations and warranties listed under Clause 5.1; (ii) any unauthorised use of the System (except to the extent such unauthorised use is by a staff of Digi); or (iii) unauthorised use of credentials by any person (other than a staff of Digi). Digi is not liable for any incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including lost revenues or profits, loss of business or loss of data, in any way related to the System or for any claim, loss or injury based on errors, omissions, interruptions or other inaccuracies in the System.
   

6. Personal Data

 
6.1 We are required to comply with the Personal Data Protection Act 2010 and we stand by our Privacy Notice when dealing with your personal information including sensitive personal data. Our Data Protection Obligations and Privacy Notice are available on Digi’s website. Please note that our Privacy Notice may vary from time to time. No prior notice will be given for the variation. Please visit our website (http://new.digi.com.my/Page/tnc/default/tnc_privacy_statement_en) periodically to review any changes made to our Privacy Notice.
   

7. Variation of Terms

 
7.1 Digi reserves the right to change the Terms and the specifications or terms in relation to the attributes of, functionality of and information provided on and/or through the System for the purposes of dealing with changing technology, security threats, changing features or offerings, internal streamlining and generally improving the quality of the services to its dealers.
   

8. Governing Law

 
8.1 This Agreement shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or relating to the Terms shall be subject to the exclusive jurisdiction of the Malaysian courts.
